Listing Terms & Conditions

1. Seller warrants they have the right to offer said instruments for sale, together with the right to grant MAESTRONET the permission to publish (electronically or otherwise) pictures and information of instruments presented for sale.
2. Seller warrants that, to the best of their ability, the information provided is accurate and fairly represents the item being sold.
3. MAESTRONET reserves the right to remove a listing at its sole discretion and without prior notice. MAESTRONET will refund any outstanding listing fees.
4. MAESTRONET may modify this agreement, rules or prices, and may discontinue or revise any or all other aspects of the Service at its sole discretion and without prior notice.
5. SELLER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT HIS/HER SOLE RISK. NEITHER MAESTRONET NOR ANY OF ITS INFORMATION PROVIDERS, LICENSERS, EMPLOYEES, OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES MAESTRONET OR ANY OF ITS INFORMATION PROVIDERS, LICENSERS, EMPLOYEES OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. NEITHER MAESTRONET NOR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. SELLER EXPRESSLY ACKNOWLEDGES THAT THE PROVISION OF THIS PARAGRAPH SHALL ALSO APPLY TO THIRD PARTY CONTENT.
6. This agreement is, and shall be governed by and construed in accordance with the law of the Province of Ontario applicable to agreements, made and performed in Ontario.
